Permitted and Prohibited Uses
Proper Use of Services
You shall not use the Services for any illegal, fraudulent, improper, or abusive purpose or in any way that:
- Interferes with Kinetic VoIP’s ability to provide high-quality Services to other customers.
- Prevents or restricts other customers from using the Services.
- Causes damage to Kinetic VoIP’s or other customers’ property.
If Kinetic VoIP determines that you are using the Services in violation of this Agreement, Kinetic VoIP may, at its sole discretion, terminate your service and charge you any applicable fees for the Services used, plus damages caused by your improper use.
Prohibited Uses
Prohibited uses include, but are not limited to:
- Engaging in illegal, obscene, threatening, harassing, defamatory, fraudulent, infringing, or deceptive behavior.
- Sending unsolicited messages or advertisements, including email, voicemail, SMS, or faxes (spamming).
- Collecting or harvesting information about others without consent.
- Transmitting harmful software such as viruses, worms, malware, spyware, or similar programs.
- Engaging in Caller ID spoofing, forging email/SMS headers, or misleading others about the origin of communications.
- Violating intellectual property rights of third parties.
- Violating U.S. or foreign laws regarding the transmission of technical data or software.
- Using Services beyond what is considered normal business use, including sharing a single VoIP line among multiple users.
- Interfering with or disrupting other customers’ use of the Services.
- Bypassing or exploiting any part of this Use Policy.
- Storing PHI (Protected Health Information) on a non-temporary basis without activation of the Kinetic VoIP HIPAA Conduit setting.
Customer Responsibilities
You are solely liable for any transmissions sent and data stored under your account. You agree to comply with all Kinetic VoIP policies, procedures, and agreements related to the Services. You shall not attempt to gain unauthorized access to the Services, accounts, computer systems, or networks.
Cancellation and Contract Terms
All service agreements — including promotional offers, free or discounted equipment arrangements, or any other commitments related to service — will automatically renew unless canceled in writing in accordance with our cancellation policy. If you terminate service before the end of your contract term, you will be responsible for a termination fee equal to the remaining balance of your contract. If you select an annual contract and terminate service before the contract term expires, you are liable for reimbursing all porting and installation fees that were originally waived as part of the contract benefits. If you reduce the number of active lines, we will negotiate a revised service rate, and a new contract will be issued to reflect the updated terms. If you port a number away from Kinetic VoIP while under a contractual agreement, you will remain responsible for fulfilling the financial obligations of your contract, including any remaining balances. The term of this agreement begins when the service is activated. It will continue as outlined in the agreement, including any renewal provisions specified. All cancellations require at least thirty (30) days’ written notice. Simply porting numbers away does not count as cancellation notice. Notice must be sent by an authorized account contact via email from their official company email or through a formal support ticket.
If no contract term is selected, the account will operate on a month-to-month basis. You must provide a minimum of thirty (30) days’ prior written notice of cancellation. Notice must be submitted by an authorized account contact via email from the authorized contact’s official company email address or through a formal support ticket. You remain liable for all applicable porting and installation fees.
Compliance with Laws and Regulations
Your use of the Services is subject to all applicable local, state, national, and international laws and regulations, including those governing:
- Account collection
- Export control
- Consumer protection
- Unfair competition
- Anti-discrimination
- Securities laws
- False advertising
Unlimited Service Plans
Terms of Unlimited Plans
Kinetic VoIP offers certain plans on an “unlimited” basis, which:
- May only be used for normal business purposes.
- Are intended for one-on-one dialogue between two individuals per line.
- Exclude international calling unless an additional fee is paid.
- Are assigned on a “one user per line” basis, meaning only one registered user may use the Services per line.
Prohibited Uses for Unlimited Plans
Unlimited plans may not be used for:
- Trunking or forwarding calls to multiple simultaneous lines or PBX systems.
- Sending bulk/junk voicemail or faxes (100+ messages at once).
- Bulk call-in services such as customer support or hotline services.
- Auto-dialing or predictive dialing software.
High Usage and Service Impact
Excessive use of the Services may impact Kinetic VoIP’s ability to provide high-quality service to all customers. If your usage is deemed excessive, Kinetic VoIP may:
- Suspend or terminate your account.
- Convert your plan to a metered calling plan with significantly higher rates (with prior notice).
Policy Modifications
Kinetic VoIP reserves the right to modify, amend, or add to this Use Policy at any time, at its sole discretion.
